    This website (www.tapadas.com) is managed by Santos & Teixeira Lda. (Hereinafter referred as “TAPADAS”) with the Tax ID number - 502 529 946, with headquarters at Avenida Irene Lisboa, Lote 19, Piso 1, Armazém D, 2635-001 Rio de Mouro.

    Below, we present our terms and conditions of use for visitors and clients on the website (Users), for the purpose of any commercial transaction through our online store.

  • Introduction

    For any clarification from our users, please carefully read our Terms and Conditions (Conditions), Privacy Policy and Cookies Policy.

    If the User does not agree, in whole or in part, with these Conditions, he/she should not access the website or the associated features and services, namely its Online Store. Making any purchase through the Online Store depends on the acceptance of these Conditions, therefore, if you do not accept them, you will not be able to use it.

    The contractual proposal relating to the purchase and sale of tradable products in this Online Store is only aimed for people with legal age and full capacity, and who, therefore, can take responsibility for the commitments resulting from the purchase and sale of the products. When accessing our website, the customer declares to be over 18 years old and to present all the characteristics mentioned above, being responsible for his order.

    By accepting the conditions, the user declares that he/she will not use the website for illegal or illicit purposes.

    TAPADAS may, at any time, update, modify or replace, totally or partially, these Conditions or the policies associated with them, announcing such changes in its own location.

    The User will be responsible for, periodically, check the occurrence of any changes since the use of the website is governed by the conditions in force at each moment of access.

    The continued access and use of this website after the publication of any updates, modifications or substitutions of the Conditions and associated policies, except for the Privacy Policy, constitutes an acceptance and agreement with these updates, modifications, or substitutions.

    TAPADAS guarantees the protection and security of the User account according to the expected security measures and suitable for platforms such as the present website and respective online store. All information or personal data provided by the User will be treated in accordance with the provisions of the Privacy Policy and the Cookies Policy.

    When using this website, the User acknowledges that his/her personal data will be treated by TAPADAS and declares that all information or data provided correspond to reality. TAPADAS cannot be held responsible for the inaccuracy of the information provided by Users, which are entirely responsible for its accuracy, completeness and updating.

    Since now, the User consents to the use of the information provided for contact purposes whenever necessary, as well as the availability, by TAPADAS, of his personal data (name, address and telephone contact) to the shipping company responsible for the delivery of the ordered products.

    In case of technical problems such as interruptions, computer viruses, malfunctions, or others, which compromise the access of our website, TAPADAS will try to reverse the situation, however, having no responsibility about the impossibility of access or damage caused, also noting that at any time, the website's operation may be temporarily suspended, to improve its functioning.

    TAPADAS reserves the right to modify, at any time, the information and commercial offer presented on products, prices, campaigns, commercial conditions, and services.

  • Customer Registration on the Website

    It is not necessary to have an account to buy on this website, however, the User can create an account to enjoy all its features. The provision of data such as: Name, Date of birth, E-mail address, Telephone number, Tax Identification Number and Address are required for this purpose.

    The User will be the only and exclusive responsible for any false or inaccurate declarations that he/she provides, as well as for all the activity that takes place in his / her account, there being no obligation from TAPADAS to monitor the contents or (non) fulfillment of any User responsibilities, namely towards other Users or national authorities.

    After the account is created, the access to the user's account is done through the email address and password created when registering. The password is restricted to the user, and TAPADAS is not responsible for its use or supplying it to others.

    It is the right of TAPADAS to cease access to the Website, by a user who does not comply with our Conditions of Use.

  • Product Availability

    Our products are available on the website as the respective information about the characteristics, stock, and delivery times.

    Our products are presented through illustrative images, bringing their essence to the image, however, they may suffer changes in color or other aspects. For example, colors may appear different on different computer screens, so, it is important for the user to carefully read the product's characteristics before the purchase.

    Any error about the product characteristics will always be rectified by our team whenever possible.

    The stock of products is always limited, and our main concern is to update it in real time. Whenever the unavailability of an item is verified, the refund to the customer is made within 30 days.

    The prices, products and campaigns on the website are only valid for online purchases. Regarding the applied prices, if an error is identified, TAPADAS will rectify the price as soon as possible, always informing the customer about that same rectification, and he is free to, if he so wishes, cancel his purchase without any loss.

    Online prices may differ, compared to physical stores, in the case of different channels. The customer will be able to choose the purchase channel, respecting the price applied. The shown prices include VAT at the legal rate in force in Portugal.

    As this is the online store, the shipping cost will be added to these prices depending on the destination of the order. There may be different promotions and campaigns which are only discounts offered at the online store. The correct prices are always those indicated in each product.

    The order is finalized after choosing the payment and delivery method. The payment methods available will always be indicated. The user chooses the payment method that is most favourable for him.

    If you choose the ATM payment method, the user will have a maximum period of 48 hours to finalize the payment, with the purchase being automatically cancelled after that period.

  • Delivery Methods

    The delivery method will always be through online purchase with delivery to the customer's address. The order is only sent after the payment confirmation.

    For parcel deliveries to the customer's address, the customer must indicate the correct address and the name of the addressee. Deliveries are available to the following countries: Portugal (Mainland and Islands), Spain (Peninsular), Germany, Austria, Belgium, Cyprus, Spanish Islands, Slovakia, Slovenia, Estonia, Finland, France, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta and the Netherlands; taking into account the variation in the value of shipping for certain areas. The Customer will receive, by email, all the information about the status of his order: order confirmation, confirmation of processing and shipping. When the order is shipped to your address, you will receive an email with its tracking number, so you can follow the delivery in real time, through our shipping company platform.

    We safeguard possible delays related to the shipping company, such as local holidays or possible delivery difficulties at the customer's address. Deliveries will be made only on working days. If the delivery of the order is not concretized, the company will contact the customer in order to reschedule or establish a collection point for the customer.

    In case of impossibility of delivering the product due to the absence of an addressee at the address indicated, the company may charge the costs related to the storage of the products and to new delivery attempts.

  • Order Confirmation

    Before finalizing the order, a list of the purchased items and their characteristics (quantity, size and color) is always shown to the user, as well as the respective prices, amount of VAT to be paid, means of delivery and form of payment and billing information, when applicable.

    The customer must confirm his order, as well as the billing and delivery details that he provided. It is important that the user reads and accepts our terms and conditions for the purpose of purchasing through our website.

    When making an online purchase on our website, a purchase and sale agreement is agreed into with TAPADAS. After the full payment for the purchased products has been made, the invoice is issued and sent to the email address provided by the user, and it is not possible to make changes after the invoice has been issued, noting that the shipping costs may be increased due to the reshipment of the order or errors related to the address provided by the customer.

    For billing, the data provided by the user at the time of registration will be used. The user can, whenever he wants, change, or update his data.

  • Return Policy

    According to the Decree Law nº 24/2014, of February 14, amended by Law 47/2012, of July 28 and Decree Law nº78 / 2018, of October 15, the Consumers, whose definition is provided in the referred legal diploma, have the right to freely terminate the contract, up to 14 days after receipt of the order, without any need for justification, with the full refund of the products and the respective shipping costs (except in the case of special shipments, which are the responsibility of the customer), ensuring that the customer only return expenses.

    If you want to return your order, the customer must wait for the receipt of the order and make the return through our website, filling out the respective form. The return of the order may be the totality of the products or just some of them, and no more than one return can be made, in different periods, for the same order. TAPADAS will acknowledge receipt of the customer's return request within 24 hours.

    The customer, after receiving the order and filling in the return data on the website, has a period of 30 days to return the products, according to the indications in the website, to our facilities, by mail to the following address:

    The return of the item is at the customer's expense and must be made using the original packaging. The product must include all order documents, labels, and product packaging.

    Returned products will always be checked to ensure that they have been returned under the same shipping conditions. The return is only validated after this verification, and the refund is made using the same payment method used by the user, being made within 30 days. The refund is retained until we receive the return form or proof, we have received the product at our facilities or if the item does not have the same conditions with which it was shipped. Any products returned for collection will not be accepted.

    In case the article does not present the initial conditions or any of the return parameters has not been respected, the refund is not made, and the customer is informed, by email, of the reasons for which it was refused. The customer has the option to request the reshipment of the product (s), assuming the transport costs of the same (s).

    All rights recognized by the law in force will be safeguarded.

  • Exchange Policy

    The product exchange option is only valid for sales made to Portugal or Spain.

    The customer has a period of 30 days from the date of receipt of the products to make the exchange of the same (exchange of color or size), accessing his Client Area on our website and filling in the product exchange form.

    • Exchange in physical store:

    The customer can make a color or size change at our physical store in Rio de Mouro, located at Av. Irene Lisboa, Lote 19, Piso 1, Armazém F, 2635-001 Rio de Mouro, free of charge.

    • Exchange via online:

    The exchange via online implies the payment of the return shipping costs by the customer and the costs of resending the order are paid by TAPADAS.

    There are no exchanges for used products, without product packaging and/or labels, or with any damage on the part of the user, so the products must be exchanged under the conditions in which they were delivered to the customer.

    The product will always be checked by our team, and as soon as we find out that it is in exact condition at the time of shipment of the order, the exchange process is analysed in order to ensure that the procedure was done within the deadlines and respecting our conditions. If it is accepted, the exchange is made, and the product will be sent.

    In case the article does not present the initial conditions or some of the exchange parameters have not been respected, it is not carried out, the customer being informed, by email, of the reasons for which it was refused. The customer thus has the option to request the reshipment of the product(s), assuming the transport costs of the same(s).

  • Exchange Policy - Defects

    TAPADAS always looks after the quality of its products, maintaining a strict quality control of them. However, and within 2 years from the date of delivery of the product, the customer is guaranteed the product. It must inform TAPADAS, within a maximum period of 2 months after the date of detection of the defect.

    During the warranty, the defective product that cannot be repaired is replaced by a new model, or similar.

    The products do not comply with the purchase and sale contract when any of the following facts occurs:

    • When the products do not comply with the description made by TAPADAS on its website;
    • When the products are not suitable for the specific use for which they are intended;
    • When the products are not suitable for the uses usually given to goods of the same type;
    • When the products do not present the usual qualities and performance in goods of the same type and which the User can reasonably expect, given the nature of the good and, eventually, the public statements about its specific characteristics, made by TAPADAS.

    When the customer finds that the item is defective, he must contact TAPADAS through the email address info@tapadas.com, presenting the defect of the item through photographs, as well as presenting the invoice.

    Subsequently, the process will be analysed by our team and if there is a defect, we will replace it at no cost, informing the customer and scheduling the collection of the damaged item.

    TAPADAS warns of possible cases in which, at the time of entering into the contract, the user becomes aware of the lack of conformity or defect in the product, and he has purchased the product under these conditions. Thus, when the product has been sold with an express indication that it contained the defect in question, it cannot be returned as defective. Without prejudice to the User, continue to have the return procedures provided for in these Conditions.

    The warranty is excluded whenever the product shows signs of misuse, namely, damage caused by blows, poor maintenance and cleaning, neglect, deterioration, oxidation, loss or loss, unauthorized repairs, modifications, accidents or normal wear and tear. damage caused by the use of other products.

    Customers who are defined as consumers by Law 144/2015 and who have entered into purchase and sale and/or provision of services contracts have the right to use official entities to assist them in resolving any conflict concerning such contracts, without prejudice to the use of judicial courts.

    There is a group of independent entities, with specialized personnel and who, in an impartial way, help the consumer and the company to reach a friendly solution through mediation or conciliation. If such an agreement is not reached, the arbitral tribunal can also be appealed through a simple and quick process.
